Whenever people ask me when someone should get a lawyer after an accident it makes me think of the Miranda Warning or Miranda Rights. If you’ve lived within the United States of America, or even ever watched TV, you have probably heard the following being recited to anyone who is being arrested on TV, or perhaps even in real life.
“You have the right to remain silent. Anything you say can be used against you in court. You have the right to talk to a lawyer for advice before we ask you any questions. You have the right to have a lawyer with you during questioning. If you cannot afford a lawyer, one will be appointed for you before any questioning if you wish. If you decide to answer questions now without a lawyer present, you have the right to stop answering at any time.”
Up until the point where it says that “a lawyer will be appointed to you..” it typically also holds true when dealing with insurance companies in a car accident cases. Now don’t get me wrong, I was referring to insurance companies and not law enforcement. In the event of an accident you should cooperate fully with law enforcement. It will probably look quite silly if you tell them that you won’t talk to them without your Accident Lawyer, specially if you’ve been severely injured. As soon as you are in an accident, check for injuries and call 911 if you or someone needs medical assistance. Should law enforcement and paramedics arrive, cooperate fully but be careful about what you tell them should they ask you “how you are doing”. We typically have an impulse to say that we are fine. Now going back to the question of how soon you should get an attorney after a car accident and my comment about the Miranda Rights.
